1. Acceptance of Terms

By engaging The Sheriff Property Inspections ("we," "us," or "our") for property inspection services, you ("client," "you," or "your") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and our company.

If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Services Provided

Inspection Services

We provide the following property inspection services:

  • Pre-purchase building inspections
  • Pest and termite inspections
  • Commercial property inspections
  • Maintenance and condition assessments
  • Emergency property inspections
  • Detailed written reports with photographs

Service Standards

Our inspections are conducted in accordance with:

  • Australian Standard AS 4349.1 for building inspections
  • Australian Standard AS 3660 for termite inspections
  • Industry best practices and professional standards
  • Relevant state and local regulations

3. Client Obligations

To ensure effective service delivery, you agree to:

  • Provide safe and reasonable access to all areas of the property
  • Ensure utilities (electricity, water) are connected and operational
  • Provide accurate property information and any known issues
  • Be present during the inspection or arrange for authorized representation
  • Make payment according to agreed terms and schedule
  • Notify us of any changes to inspection requirements or scheduling
  • Comply with all safety requirements and instructions

4. Limitations and Exclusions

Important Limitations

Please read this section carefully as it outlines important limitations of our inspection services.

Scope of Inspection

Our inspections are visual assessments of accessible areas only. We do not:

  • Move furniture, stored items, or floor coverings
  • Perform destructive or invasive testing
  • Inspect areas that are inaccessible or unsafe
  • Test electrical, plumbing, or HVAC systems beyond visual inspection
  • Provide cost estimates for repairs or renovations
  • Guarantee the absence of defects or pests

Weather and Environmental Conditions

Inspections may be limited by weather conditions, and some defects may only be apparent under specific conditions (e.g., water leaks during rain). We are not liable for defects that are not visible or detectable during normal inspection conditions.

5. Payment Terms

  • Payment is due upon completion of the inspection unless otherwise agreed
  • We accept cash, bank transfer, and major credit cards
  • Late payment may incur additional charges as specified in your service agreement
  • Disputed charges must be raised within 30 days of invoice date
  • Refunds are provided only in accordance with our refund policy
  • All prices include GST where applicable

6. Liability and Insurance

Professional Indemnity

We maintain professional indemnity insurance coverage of $2,000,000. Our liability is limited to the amount of this insurance coverage or the fee paid for our services, whichever is lower.

Limitation of Liability

To the maximum extent permitted by law, we exclude liability for:

  • Consequential, indirect, or special damages
  • Loss of profits, revenue, or business opportunities
  • Defects not reasonably detectable during visual inspection
  • Changes in property condition after inspection date
  • Reliance on our reports by third parties without our consent

7. Intellectual Property

All inspection reports, photographs, and documentation remain our intellectual property. You are granted a non-exclusive license to use these materials for the specific property transaction or purpose for which the inspection was commissioned.

You may not reproduce, distribute, or use our reports for any other property or commercial purpose without our written consent.

8. Cancellation and Rescheduling

  • Cancellations with more than 24 hours notice: No charge
  • Cancellations with less than 24 hours notice: 50% of inspection fee
  • No-show or same-day cancellation: Full inspection fee
  • Weather-related cancellations: No charge, rescheduling at no extra cost
  • We reserve the right to cancel inspections for safety reasons

9. Dispute Resolution

In the event of a dispute, we encourage resolution through direct communication. If this is unsuccessful, disputes will be resolved through:

  • Mediation through a mutually agreed mediator
  • If mediation fails, binding arbitration under NSW Commercial Arbitration Act
  • All disputes are subject to NSW law and jurisdiction
  • Claims must be made within 12 months of the inspection date

10. Privacy and Confidentiality

We respect your privacy and maintain confidentiality of all client information. Our privacy practices are detailed in our Privacy Policy, which forms part of these terms.

We may use anonymized case studies and photographs for marketing purposes, but will not disclose client or property-specific information without consent.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any legal proceedings will be conducted in the courts of NSW.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
